ORDER
This writ petition has been filed seeking a direction to the 1st respondent to calculate and provide compensation for erected tower with heavy tension line in petitioner's property comprised in Ka.Sa.No.620/1C having extent of 0.40 Acre situated at Karumathampatti Village, Sulur Taluk, Coimbatore District by considering the petitioner representation dated 24.08.2023.

The learned counsel for the petitioner would submit that the petitioner is the owner of the property in Survey No.620/1C measuring an extent of 0.40 Acre situated at Karuthampatti Village, Sulur Taluk, Coimbatore District wherein the heavy electricity Tower was erected by the 1st respondent and thereby the petitioner sustained a loss for not using the land. Hence she filed the present Writ Petition, seeking aforesaid relief.
3. The learned counsel appearing for the first respondent would 2/5
submit that the Heavy Electricity Tower was erected only in terms of Indian Telegraph Act, 1885. If the petitioner claims any compensation, she has to file an application under Section 16 of the Indian Telegraph Act, 1885 before the District Collector.

In view of the above, since the District Collector, Coimbatore is the competent authority to consider the case of the petitioner, this Court suo motu impleads the District Collector, Coimbatore, having office at Collector Office, State Bank Road, Gopalapuram, Coimbatore 641 018, as 2nd respondent in this writ petition for whom, Ms.Anitha, learned Special Government Pleader accepts notice.

The petitioner is directed to submit a fresh application in terms of Section 16 of the Indian Telegraph Act, 1885 to the 2nd respondent viz., the District Collector, Coimbatore, within a period of two weeks from the date of receipt of a copy of this order. On such application being made, the District Collector, Coimbatore shall consider the same and pass appropriate orders on merits and in accordance with law after affording an opportunity 3/5
of hearing to the petitioner and the interested parties, within a period of eight weeks thereafter.
