Criminal Original petition has been filed under Sections 439 (1) (b) of the Code of Criminal Procedure, to modify the order dated 05.12.2019 passed by the learned Principal Sessions Judge, Salem in C.M.P.No.3895 of 2019.

O R D E R

This Criminal Original petition has been filed seeking modification of the condition imposed on 05.12.2019 in C.M.P.No.3895 of 2019 by the learned Principal Sessions Judge, Salem.

2. The petitioner was granted bail vide order dated 04.10.2019 in C.M.P.No.3138 of 2019 by the learned Principal Sessions Judge, Salem, on condition to report before the respondent police daily twice at 10.00 a.m., and 5.00 p.m., until further orders. Thereafter the conditions were modified twice. Now, the petitioner has filed to modify the condition to report before the respondent police once in fifteen days at 10.30 a.m., until further orders.

3. The learned counsel for the petitioner submitted that the condition imposed by the learned Sessions Judge has been modified twice and as per the order, the petitioner has been https://hcservices.ecourts.gov.in/hcservices/

appearing and signing before the respondent police once in fortnight. The learned counsel for the petitioner further submitted that the petitioner is willing to appear before the concerned Magistrate, instead of the respondent police.

4. The learned Government Advocate (Crl.Side) submitted that he has complied the conditions till 03.12.2019.

5. Considering the said submissions, the condition imposed as against the petitioner is modified to the effect that the petitioner is directed to appear before the learned Judicial Magistrate-II, Salem, fortnightly i.e., on 1st and 15th of every month at 10.30 a.m., and 5.30 p.m., until further orders.
