The petitioner/A3 seeks bail in Crime No.481 of 2023, registered by the respondent police for the offences punishable under Sections 393 & 397 of IPC. The petitioner had been remanded to custody on 21.11.2023. 2.It is the case of the defacto complainant that he/ the Account Clerk and another person Accountant had taken money from Boobalan Jewellery and were going to deposit he same in HDFC Bank to a sum of Rs.60,00,000/- in a motorcycle. The accused, who had come in another motorcycle had dashed against the motorcycle driven by the defacto complainant and had thrown chilli powder in their face and tried to snatch the bag. However, since it was a crowded area, they were secured.

3.The learned counsel for the petitioner stated that the name of the petitioner is not found in FIR. It is also stated that only two persons were coming but the prosecution relies on the confession that three persons had come over to Chennai for this particular purpose. Moreover, when chilli powder is 1/3

thrown on any person he can never identify the person who had thrown it and would not know the name and address of that person. 4.In view of all these factors, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed. 14.12.2023 ata 2/3
