Today, when the matter is taken up for hearing, learned Government Advocate (Crl. Side) appearing for the respondent police submitted that the offence committed by the petitioner has been altered to Section 109(1) of BNS, 2023. Hence, the learned counsel for the petitioner seeks permission of this Court to withdraw this petition and he has also made an endorsement to that effect with liberty to file a fresh petition.

2. In view of the submissions made on both sides and the endorsement made by the learned counsel for the petitioner, this Criminal Original Petition is dismissed as withdrawn with liberty to file a fresh petition.
