The Criminal Original Petition has been filed seeking a direction to the respondent Police not to harass the petitioner under the guise of investigation/enquiry.

Heard both sides and perused the materials available on record. It is the contention of the learned counsel appearing for the petitioner submitted that based on the complaint given by the de facto complainant/third respondent, the respondent Police are unnecessarily harassing the petitioner under the guise of enquiry. He also submitted that three civil suits are already pending between the petitioner and the third respondent and that the third respondent has now approached the Police by giving a criminal color to the civil dispute. 4.

In such view of the matter, as the civil dispute is already the subject matter of pending civil suits, it should be adjudicated before the competent civil court. Therefore, the respondent Police are directed not to interfere in the civil dispute between the petitioner and the third respondent, except in the event of any law and order issue arising therefrom, which may warrant initiation of criminal proceedings. The respondent Police shall also refrain from summoning the petitioner for enquiry unnecessarily. Accordingly, the parties are relegated to work out their remedies before the civil Court.
