ORDER

The petitioner who apprehend arrest at the hands of the respondent police for the alleged offence under Sections 465, 468, 420, 209 and 201 of I.P.C. in Cr.No.1 of 2018 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner met with an accident during the year 2009 and he filed claim petition in MCOP No.463 of 2009 and he was awarded a sum

of Rs.1,36,000/- as compensation and aggrieved by the same, CMA No.916 of 2016 was filed before this Court and this Court granted interim stay in the said appeal. Whileso, on verification by the Insurance Company, it was found that the insurance copy produced by the petitioner was a bogus one. 3.The learned counsel appearing for the petitioner submitted that earlier the petitioner filed Crl.O.P.No.23254 of 2018 before this Court and on 01.09.2021, this Court granted anticipatory bail to the petitioner. Thereafter, the petitioner was not able to comply with the conditions imposed in the said order and hence the order dated 01.09.2021 lapsed. Hence, the petitioner has filed this petition. 4.Heard the submissions made by the learned Government Advocate (Criminal Side). 5.Though the order dated 01.09.

2021 makes it clear that if the petitioner, failed to surrender before the concerned Magistrate within a period of 15 days from the date of receipt of a copy of the order, the order shall stand automatically cancelled, the law enforcing agency has not taken any steps to secure the accused and allowed the accused to be free for the past three years.
