O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offence under Section 329(4), 296(b), 76 and 351(3) of BNS Act, 2023 r/w Section 3 of Tamil Nadu Prohibition of Harassment of Women Act, 1998 in Crime No.216 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner was residing in the very same building of the defacto complainant's house. While the defacto complainant was sleep inside her house along with his son, the petitioner herein sneak in to the house and attempted to commit rape. Hence, the case has been registered.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. He also submits that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal side) for the respondent police, reiterated the prosecution case and submitted that the petitioner trespassed in to the house of the defacto complainant and attempted to commit rape. However, he opposed to grant anticipatory bail to the petitioner.

5. Considering the above facts and circumstances of the case, taking note of the submission made by the learned Government Advocate (Criminal Side), and since the allegation against the petitioner is he sneak into the house 2/4

of the defacto complainant and attempted to commit rape, I am not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed. 18.09.2025 ssi To 1.The Additional Mahila Court, Vellore.
