ORDER

This petition has been filed to relax/modify the condition imposed in Crl.M.P.No.18442 of 2023 in Crl.M.P.No.124 of 2023 in Crl.A.No.12 of 2023 dated 24.11.2023 that the petitioner shall appear before the trial court once in three months at 10.30 a.m., starting from the 1st working day of January 2024, until further orders.

2.The learned counsel for the petitioner submitted that the petitioner is aged about 62 years. He has to travel to his native place at Allahabad in order to take care of his personal matters and for certain obligations. Hence, he finds it difficult to comply with the condition in view of his old age. Hence, prays to 2/4

relax the condition.

3.The learned Special Public Prosecutor appearing for the respondent police submitted that the petitioner is complying with the conditions regularly without any deviation.

4.Considering the facts and circumstances of the case, age of the petitioner and also considering the submission made by the learned Special Public Prosecutor that the petitioner is complying with the conditions diligently, the order dated 24.11.2023 made in Crl.M.P.No.18442 of 2023 in Crl.M.P.No.124 of 2023 in Crl.A.No.12 of 2023 is modified to the effect that the petitioner shall appear before the trial Court once in six months at 10.30 a.m., on the first working day of the month, until further orders. All other conditions remain unaltered.
