ORDER

The petitioner, who was arrested and remanded to judicial custody on 12.08.2025, for the offences punishable under Section 294(b), 435 of I.P.C in Crime No.948 of 2017, registered on the file of the respondent police, seeks bail.

2.The petitioner is facing trial in C.C.No.1085 of 2025 on the file of XV Metropolitan Magistrate Court, GT Chennai. He has not co-operated with the process of trial. Hence NBW was issued against him on 20.03.2024 and the petitioner was absconding for more than a year and NBW was executed on 12.08.2025 and he was remanded to judicial custody on the same day.

3.The learned counsel appearing for the petitioner submitted that originally the petitioner was not aware about the hearing. Hence, he was not appeared on the date of hearing before the Trial Court for the case in C.C.No.1085 of 2025 and due to his non-appearance before the Trial Court on 12.08.2025 a NBW was issued as against the petitioner and subsequently, the petitioner was arrested on the same day. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner. 4.The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioners, reiterated the prosecution case and submitted that LW4 to LW6 and the case is pending from 2021.

5. Considering the facts of the case and the case is pending is from 2021, this Court is not inclined to grant bail to the petitioner.
