The petitioner, who was arrested and remanded to judicial custody on 17.09.2023 for the offences under Section 354(A) of IPC r/w Sections 9(f), 10 of POCSO Act r/w Section 4 of TNWH Act, in Crime No.20 of 2023, seeks bail.
2.The learned counsel for the petitioner stated that the petitioner was working as a music teacher in Udavi Gentillesse Matric School. The victim girl is aged 15 years and the petitioner is aged 55 years. It is stated that he had committed the offences stated on the victim girl. The offence had taken place on 14.07.2023 but the complaint was lodged after two months and the petitioner had been taken into custdoy on 17.09.2023. It is also stated that the petitioner was suspended from the school and owing to that as a motive, a false complaint has been given. 3.The statement of the victim girl under Section 164(5) Cr.P.C had been recorded and in the statement, the victim girl has clearly stated the facts as stated in her complaint.

sli 4.The earlier bail application had been dismissed on 08.11.2023 in Crl.O.P.No.25625 of 2023 and it had been observed that the victim child will have to be given protection till she tenders evidence. She had not tendered evidence as on date. There is no change in circumstances. 5.In view of that particular fact, without any further discussion, this Criminal Original Petition stands dismissed.
