This petition has been filed to condone the delay of 305 days in filing the petition to restore the above appeal which was dismissed against the respondents 2 to 4.

2. Heard the learned counsel appearing for the petitioner, the learned counsel appearing for the first respondent and the learned counsel appearing for the third respondent.

3. Being satisfied with the reasons stated in the affidavit filed in support of the petition, this Court is inclined to order this petition.

4. Accordingly this petition is allowed.
