This petition is filed to condone the delay of 291 days in filing the appeal.

Heard Mr.P.Suresh Srinivasan, learned counsel for the petitioner.

It is submitted by learned counsel for the petitioner that the second respondent is the owner of the vehicle and he is also no more. Therefore, he is not a main contesting respondent.

The first respondent being the main contesting respondent, having been served and Mr.S.P.Yuvaraj, learned counsel entered appearance on behalf of the first respondent, though he has made objections to condone the delay, having been satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 291 days in filing the appeal is condoned.

Accordingly, the petition stands ordered.
