ORDER
The petitioner seeks a direction upon the respondents to release the money saved by his mother, which is lying in the bank of the 2nd respondent.
2. Since no adverse order has been passed against the respondents, notice to the respondents is dispensed with.
3. The petitioner claims that he is the clause 1 legal heir of his deceased mother Anjala Mary @ Angel Mary. According to the petitioner, his mother died due to ill-health on 19.10.2021 at Rajiv Gandhi Government General Hospital. After her demise, the petitioner made a representation to the respondent-bank to release the amount lying in the credit of his mother. Since there was no response from the Page No.2 of 6
respondent-bank, the petitioner made a representation dated 27.06.2025 before the respondents seeking release of funds held by his mother. As the said representation was not acted upon by the respondents, the petitioner has approached this Court by way of this writ petition for appropriate orders.

Though the petitioner claims that he is the son and clause 1 legal heir of the deceased Anjala Mary @ Anjel Mary, no piece of paper is produced by the petitioner showing that he is the legal heir of the deceased. He has not even enclosed the legal heirship certificate issued by the revenue authorities. Upon the demise of a parent, a legal heirship certificate is the only document, which would prove the relationship between the parties and also the legal right. In the absence of the same, the petitioner cannot expect the authorities to act upon his representation and release the huge funds maintained by his mother. Hence, the prayer sought for by the petitioner cannot be granted and this writ petition is liable to be dismissed.

5. Accordingly, this Writ Petition is dismissed. However, the petitioner is at liberty to approach the appropriate authority for obtaining the legal heir certificate and thereafter, he can approach the respondents for disposing his representation. No costs.
