ORDER

The petitioner, who was arrested and remanded to judicial custody on 24.08.2025 for the alleged offences punishable under Sections 123 and 286 of 1/4

BNS, 2023 (328 of I.P.C.) r/w 24(1) of Cigarette and other Tobacco Products Act, 2003 in Crime No.399 of 2025 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner along with another accused was found in illegal possession of 350 kgs. of banned Tobacco products. Hence, the case.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case and there was no recovery from the petitioner. Hence, he prays to grant bail to the petitioner.

4.The learned Government Advocate (Crl. Side) submitted that in this case there are totally two accused, the petitioner is ranked as A1. He further submitted that the petitioner along with another accused was found in possession of huge quantity of banned Tobacco products. He further 2/4

submitted that the petitioner is having one previous case of similar in nature. Hence, he strongly opposed to grant bail to the petitioner. 5.Heard both sides and perused the materials available on record. 6.Considering the fact that the petitioner was arrested recently and one previous case is also reported, which is similar in nature, I am not inclined to grant bail to the petitioner.
