The Petitioner seeks anticipatory bail in Crime No.1051 of 2020 registered by the Respondent Police originally as woman missing and later altered as Sections 302, 201, 342, 343, 346, 363, 365, 506(i) and 34 IPC.

2. It is the case of the prosecution that the sister of the defacto complainant was missing and after investigation, it had been detected that the Accused had committed the murder. The Accused A3 is the husband of the deceased. The Accused A1 and A2 had a quarrel with the deceased with respect to an amount borrowed by the deceased. It is stated that all the other Accused persons including this Accused had assaulted the deceased and dipped the deceased into water and committed murder. They, then buried the body of the deceased in the garden.

3. It is stated by the learned Government Advocate (Criminal Side) on behalf of the Respondent that originally a charge sheet was filed showing all the three of the Accused persons as absconding but the learned Judicial Magistrate had wanted the Respondent to indicate about the status of 1/3

securing the Accused. Thereafter, two of the Accused persons had been secured. Thereafter, this petition has been filed seeking anticipatory bail.

4. The learned counsel for the Petitioner stated that the Petitioner had not committed any offence as alleged and was in no way connected in this case, even according to the prosecution. Thus, he prays for grant of anticipatory bail to the Petitioner herein.

5. Taking into consideration that the Petitioner has been absconding for the past three years, I am not inclined to grant anticipatory bail to the Petitioner herein. Accordingly, this Criminal Original Petition seeking anticipatory bail stands dismissed.
