ORDER

The learned counsel appearing for the petitioner would submit that the first petitioner's husband as well as the second petitioner's father, one K. Srinivasan met with a road accident on 31.08.2023, for which, the Red Hills Traffic Investigation Police, Madhavaram Milk Colony Police Station, Chennai registered a case in Crime No.548/RH3/2023 on 31.08.2023. Subsequently, he died on 02.09.2023 at Government Stanley Hospital due to fatal injuries sustained in the said road accident. Thereafter, the second respondent issued a death certificate for the deceased K. Srinivasan on 26.09.2023 by mentioning the name of the deceased wife as Dhanalakshmi and the name of the deceased father as Govindan. However, the name of the petitioner's father is Kolappan and the first petitioner is the wife of the deceased, for which, the first petitioner made a representation for issuance of correct death certificate to them on 18.10.2023 and the same was rejected on the ground that the Hospital records show the name of one Dhanalakshmi as the wife of the deceased.

2. Challenging the same, the present writ petition has been filed before

this Court. This Court issued a direction to the local jurisdictional Police Station to ensure the appearance of the said Dhanalakshmi before this Court. The jurisdictional Law Enforcing Authority produced the said Dhanalakshmi before this Court today and confirmed her identity and this Court also interacted with the said Dhanalakshmi. She made a statement that there is no proof available with her with regard to the marriage entered into between her and the deceased K. Srinivasan.

3. In view of the above, this Court directs the respondents to carryout the necessary corrections in the death certificate issued for the deceased K. Srinivasan on 26.09.2023 by mentioning the name of the first petitioner viz., S. Jayanthi as wife of the deceased K. Srinivasan and the name of the father of the deceased K. Srinivasan as Kolappan and issue a fresh death certificate within a period of two weeks from the date of receipt of a copy of this order.

4. Liberty is granted to the said Dhanalakshmi to work out the remedy before the competent Civil Court in the manner known to law.

5. In terms of the above directions, this writ petition is disposed of. No Costs. Consequently, connected miscellaneous petitions are closed.
