[Order of the Court was made by S.M.SUBRAMANIAM, J.

] Karthick, the petitioner herein, is the first accused. The petitioner has been convicted under Sections 302 and 380 of IPC by the respondent Police and sentenced on 03.03.2022 in SC.No.106/2018 by the Sessions Judge, Mahalir Neethi Mandram, Allikulam, Chennai.

2. It is not in dispute that the earlier application filed under Section 389(1) Cr.P.C. to suspend the execution of the sentence of imprisonment was dismissed by this Court on 26.09.2022. The said order was passed considering the nature of evidence available on record, which led to his conviction.

3. We do not find any reason to differ from the observation made by this Court in order dated 26.09.2022 and the grounds raised by the petitioners are to be adjudicated during the course of criminal appeal.
