This Criminal Miscellaneous Petition has been filed seeking to relax the condition imposed by this Court in Crl.M.P.No.18706 of 2019 in Crl.A.No.504 of 2016 vide order dated 17.12.2019, to appear before the trial Court once in a year i.e., 1st week of January.

2. Learned counsel for the petitioner/appellant submitted that the petitioner is suffering from heart ailments and he also underwent a Fistulectomy Operation on 24.08.2023. He further submitted that since the petitioner is in continuous treatment, he is unable to move from bed. Therefore, the present petition has been filed seeking to relax the condition.

3. In reply, the learned Special Public Prosecutor for CBI Cases submitted that the only condition imposed upon the petitioner is to appear before the trial Court once in a year i.e., 1st week of January. Therefore, he objected for modifying the condition.

4. At this juncture, the learned counsel for the petitioner/appellant submitted that the petitioner would be represented by his counsel before the trial Court and he would also get ready for the disposal of the appeal. https://www.mhc.tn.gov.in/judis

The reasons adduced in the affidavit filed in support of this petition being satisfactory and considering the submissions made by the learned counsel for the petitioner, this criminal miscellaneous petition stands ordered and the condition imposed by this Court in paragraph 4 in Crl.M.P.No.18706 of 2019 in Crl.A.No.504 of 2016 vide order dated 17.12.2019, is modified to the effect that "the petitioner/appellant shall be represented by his counsel before the trial Court twice in a year i.e., on the 1st working day of January and June, until further orders."
