ORDER
The instant writ petition has been filed with a prayer of mandamus directing the respondents to permit the petitioner to attend the 4th Semester classes of II year B.Sc (BMS) offered by the 1st respondent institution.
2. The learned counsel for the petitioner submitted that the petitioner's mother received a communication dated 08.11.2024 along with the details of the misconduct levelled against the petitioner. The learned counsel further submitted that the petitioner was directed to attend remedial classes. In this connection, the petitioner submitted a representation to the first respondent on 14.11.2024, expressing his willingness to comply with any conditions imposed by the first respondent in order to be permitted to attend the 4th semester classes. However, despite being instructed to meet the Dean, the petitioner was not allowed to attend the 4th semester classes. Hence, the petitioner has come up with the present writ petition seeking a writ of mandamus directing the respondents to permit him to attend the 4th semester classes of the II year B.Sc., (BMS) course.

At this juncture, the Standing Counsel appearing for the first respondent submitted that due to the petitioner's misconduct and the irregularities committed by him, a detailed enquiry was conducted, in which, the petitioner's mother also participated. After elaborate enquiry, a decision was taken on 24.03.2025 not to permit the petitioner to rejoin the programme, as he is not eligible to proceed to any subsequent semester without completing the first semester, in accordance with the applicable regulations. It is the further submission of the learned Standing Counsel that the said order has already been communicated to the petitioner. Hence prayed to dismiss the present writ petition.
4. I have given my anxious consideration to either side submissions and also perused the materials available on record.
5. It is not in dispute that the present writ petition has been filed seeking permission for the petitioner to attend the 4th semester classes. However, the first respondent, after conducting a detailed enquiry, has taken a decision on 24.03.2025 not to permit the petitioner to rejoin the programme, on the ground 3/5
that he is ineligible to attend classes without completing the first semester, as per the applicable regulations. In view of this, once a decision has already been taken by the first respondent, the question of directing them to allow the petitioner to attend the 4th semester does not arise. Accordingly, the present writ petition deserves to be dismissed. However, the petitioner is given liberty to challenge the order dated 24.03.2025, in accordance with law.
