The State represented by its Inspector of Police, Avinashipalayam Police Station, Tiruppur South Taluk, Tiruppur District.
... Respondent Prayer : Criminal Original Petition filed under Section 482 of Code of Criminal Procedure/Section 528 of Bharatiya Nagarik Suraksha Sanhita to direct the respondent Police to furnish the closure report to the petitioner in respect of Crime No.163 of 2014 on the file of the respondent Police and till such time, to direct the learned Judicial Magistrate, Palladam, not to pass orders in Crl.M.P.No.2398 of 2024.

The petitioner seeks a direction to the respondent Police to furnish the closure report to the petitioner in respect of Crime No.163 of 2014 on the file of the respondent Police and till such time, to direct the learned Judicial Magistrate, Palladam, not to pass orders in Crl.M.P.No.2398 of 2024. 2.Originally, the petitioner lodged a complaint before the respondent Police for the alleged trespass by third parties. Based on such complaint, an FIR came to be registered in Crime No.163 of 2014 for the offences under Sections 147, 448 and 427 IPC. After investigation, a closure report has been filed and the same has now been taken on file in R.C.S.No.2398 of 2024 by the learned Judicial Magistrate, Palladam. It appears that the matter is posted tomorrow i.e., on 23.09.2025, before the same Court. The petitioner seeks a direction to the Police to furnish a copy of the closure report.
3.However, learned Additional Public Prosecutor would submit that, since the matter is of the year 2014, no copy of closure report is available with the Police. Be that as it may. As the petitioner has already engaged a
lawyer before the trial Court, let the trial Court furnish a copy of the closure report and thereafter, grant sufficient time to the petitioner to canvass his case.
4.Accordingly, the trial Court is directed to furnish a copy of the closure report to the petitioner and thereafter proceed, after giving opportunity to the petitioner. With the above direction, this Criminal Original Petition is disposed of. Consequently, connected miscellaneous petition is closed.
