To withdraw the case pending in HMOP No.
510 / 2025 before the Honble Sub Court at Alandur and transfer the same to the Honble VI Additional Family Court Chennai.
PRAYER IN CMP: To stay all further proceedings in HMOP No.510 of 2025 pending before the Sub Court, Alandur pending disposal of the above transfer petition.

ORDER
1.Heard.
2. This Transfer Civil Miscellaneous Petition is filed under Section 24 CPC to withdraw H.M.O.P. No.510 of 2025 pending on the file of the Subordinate Court, Alandur, and transfer the same to the file of the VI Additional Family Court, Chennai.

Despite the name of the respondent being printed in the cause list, today when the matter is taken up for hearing, none appeared on behalf of the respondent.
4.The marriage between the petitioner and the respondent was solemnized on 29.04.2021 at Thiruvalluvar Thirumana Mandapam, Anna Nagar, Chennai as per Hindu rites and customs. The husband has filed H.M.O.P. No.510 of 2025 seeking divorce before the Subordinate Court, Alandur. The petitioner has already filed a maintenance proceeding in M.C. No.439 of 2025 on the file of the VI Additional Family Court, Chennai.

It is desirable that the disputes between the same parties are dealt with by one forum to ensure consistency and effective adjudication. Transfer would avoid multiplicity of proceedings and the possibility of conflicting orders In view of the above, this Court is of the view that the prayer for transfer deserves to be allowed.

Accordingly, TR.C.M.P. No.1063 of 2025 is allowed and H.M.O.P. No.510 of 2025 on the file of the Subordinate Court, Alandur, is withdrawn and transferred to the file of the VI Additional Family Court, Chennai. The Subordinate Court, Alandur shall transmit the entire records to the VI Additional Family Court, Chennai within three weeks from the date of receipt of a copy of this order and the VI Additional Family Court, Chennai shall dispose of the matter in accordance with Law, as expeditiously as possible, uninfluenced by any observations made in this order and consequently, C.M.P. No.23973 of 2025 is closed. No costs.
