This petition has been filed to condone the delay of 1644 days in filing the CMA.

2. Mr.K.Poomalai, learned counsel takes notice for the second respondent.

Though notice has been served on the first respondent, he has not appeared before this Court in person or through counsel.

3. Being satisfied with the reasons stated in the affidavit filed in support of this petition, the delay is condoned and accordingly, the petition is ordered.

5. Registry is directed to number the appeal and post the matter in the usual course. The appellant is not entitled any interest for the delay period.
