Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, call for the records of the 5th respondent and subsequently quash the release deed which was executed in excess of the original allocation which was registered as Document No. 3174/ 2002 dated 31.12.2002 and subsequent release deeds bearing Document No. 5358/ 2008 dated 22.07.2008 and Doc. No. 878/ 2021 dated 27.01.2021 and subsequently direct the 3rd respondent to conduct fresh survey of the property situate at S.No. 425 Thennamanallur Village, Perur Taluk, Coimbatore district admeasuring an extent of 4.09 acres and restore the UDR as per the partition deed dated 5.12.1974 bearing Document No. 2894 of 1974 with drone equipment within a specified time frame in accordance with law For Petitioner : Ms.P.Shri Shanthaaji For Respondent : Mr.G.Velu, AGP, for R1 to 3 & 6 Mr.P.Harish, GA, for R4 &5

ORDER

The learned counsel for the petitioner seeks leave of this Court to withdraw this petition and in this regard, he had also made an endorsement in the case bundle. Further, he requests this Court to grant liberty to the petitioner to file a fresh petition. 2/4

2. In view of the above, this writ petition is dismissed as withdrawn. The liberty is granted to the petitioner to file a fresh petition. No cost.
