(Order of the Court was made by R. SURESH KUMAR, J.) There are three respondents in this civil miscellaneous petition and the respondents 1 & 2 have been served and represented by Mr.M.R.Ramasubramaniam, learned counsel for the respondents 1 & 2 who opposes this petition.

2. The third respondent already given up before the Tamil Nadu Real Estate Appellate Tribunal, therefore, Mr.P.S.Sassamk, learned counsel for the petitioner wants to give up the third respondent in this civil miscellaneous petition as well as in the main CMSA. His submission 1/4

is recorded. Therefore, the third respondent from the array of parties is hereby removed.

3. We have gone through the reasons stated in the affidavit filed in support of the petition, especially at Paragraph No.13 of the affidavit, having satisfied with the same, we are inclined to accept this petition. 2/4
