C.M.P.No.28678 of 2023 and M.P.Nos.1 of 2007 & 3 of 2013 in S.A.No.361 of 2007 C.KUMARAPPAN, J The learned counsel for the petitioner is present. The learned counsel would submit that when the matter was listed on 17.11.2023, the name of the counsel viz., Mr.R.Dhamodaran has been printed.

However, in the subsequent hearings on 27.11.2023, 06.12.2023 and 08.12.2023, instead of his name, the name of the earlier counsel viz., Mr.K.S.Vaithyanathan was printed and that is why, he was not able to appear before this Court.

2.In view of such peculiar circumstances, even without issuing notice to the respondents, this Court deem it appropriate to allow this application.

3.In the result, C.M.P.No.28678 of 2023 is allowed and Registry is directed to restore the second appeal in S.A.No.361 of 2007. Post the matter on 09.01.2024.
