ORDER
The writ petition has been filed seeking for the following prayer: "for a Writ of Mandamus directing the respondents to pay the arrears of salary as recommended by the 7th Pay Commission as per G.O.Ms.No.303 Finance (Pay Cell) Department dated 11.10.2017 as approved by the Governing Council of the respondents institutions in the G.C.Meeting held on 29.10.2018 to the petitioners within a time as fixed by this Hon'ble Court." 2.The petitioners are retired non-teaching staffs of respondents Institute of Road and Transport Technology Erode on various dates from May 2022 to September 2024 after serving not less than 30 years. The 7th Pay Commission for revision of salary was implemented by G.O.Ms.No.303, Finance (Pay Cell) Department dated 11.10.2017 notionally with effect from 01.01.2016 and monetary benefit with effect from 01.10.2017 based on the recommendations of
the Official Committee of Tamil Nadu Revised Pay Rules, 2017. Though 1st respondent has already calculated the arrears amount individually as on 30.07.2019 till date they did not take any step for paying the arrears despite the representations of the petitioners on 31.07.2025, 01.08.2025, 04.08.2025, 06.08.2025 and 07.08.2025. Hence the petitioners have filed the present Writ Petition with the above said prayer.
3.The learned Standing Counsel appearing for the first respondent filed the proceedings of the first respondent dated 03.11.2025, wherein it is stated as follows;
"In pursuant to the resolution Item No.15, passed at the 53rd Special, Governing Meeting held on 30.09.2025 had approved to pay the arrears to the employees of the Institute of Road Transport (IRT). Diver Training Wing, Gummidipoondi, non teaching staff of Institute of Road and Transport Technology (IRTT) and three IRTPolytechnic College in nine consecutive installments as recommended by the Sub Committee disburse the balance 75% of the arrear amount for the revised pay fixed for the period from 01.10.2017 to 30.06.2019 in 9 consecutive installments i.e November 2025 to July 2026.
Staff of erstwhile PMCH (now Government Erode Medical College & Hospital Perundurai) are eligible for Balance 75% of the arrear amount due from the period 01.10.2017 to 31.03.2019 as notified in the reference in 9 consecutive installments i.e. Nov'25 to July'2026 only as the college has been taken over from 01.04.2019
by Health & Family Welfare Department and to remit the with held 25% EPF (Employee Contribution) amount as per of 2nd cited, to Govt. Erode Medical College & Hospital, Perundurai EPF account."
4.Recording the same, the writ petition is disposed of. It is needless to state that the amounts due to the petitioners will be disbursed by the respondents within a period of six weeks from the date of receipt of a copy of this order. No costs.
