Prayer: Petition is filed under Article 226 of the Constitution of India, seeking Writ of Mandamus, directing the 3rd respondent to provide employment to the petitioner's 1st son Palaniappan on compassionate grounds in the light of the order passed in WP.No.25017 of 2021 dated 13.02.2024 within a time frame.

ORDER

This Writ Petition is filed for the relief of a Mandamus, directing the 3rd respondent to provide employment to the petitioner's 1st son Palaniappan on compassionate grounds in the light of the order passed in WP.No.25017 of 2021 dated 13.02.2024 within a time frame. 2/6

2. The petitioner would submit that earlier, she had filed a Writ Petition in WP.No.25017 of 2021 and this Court by order dated 13.02.2024 was pleased to observe as under:

"7.Since the name of the petitioner as well as the 4th respondent find place in the Service Register of the deceased Bannari, the respondents 1 and 2 is directed to conduct an enquiry on the strength of the Succession Certificate / Legal Heirship Certificate, if any obtained by the parties and then take a decision. If the respondents 4 to 6 do not come forward and object for compassionate appointment being given to the petitioner's son, the same shall be executed, if he is otherwise eligible."

3. Pursuant to the above order, enquiry was conducted on 03.07.2024. However, no orders have been passed till date. Aggrieved by the inaction on the part of the 3rd respondent, the petitioner is before this Court.

4. Heard the learned counsels on the either side and perused the records.

5. Considering the fact that an enquriy has been conducted as early as on 03.07.2024 and no orders have been passed till date, a direction is issued to the 3rd respondent to pass orders based on the enquiry, within a period of 8 weeks from the date of receipt of a copy of this order. It is made clear that this Court has not made any observation with regard to the merits of the petitioner's claim and the 3rd respondent shall consider the petitioner's claim and pass orders independently based on the available materials.

6. This Writ Petition is disposed of with the aforesaid direction and observation. No costs.
