ORDER

The petitioner, who was arrested and remanded to judicial custody on 03.08.2025, for the offences punishable under Sections 7 r/w 8 of the POCSO Act, 2012 in Crime No.11 of 2025, registered on the file of the respondent police, seeks bail.

The case of the prosecution is that the petitioner has committed aggravated sexual assaulted on the minor victim girl who is 10 years old. Based on the complaint given by the parents of the victim girl, the case has been registered.

3.The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner. 4.The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the 2/4

prosecution case and states that investigation in this is case not yet completed and also produced the statement recorded from the victim girl.

5. On a perusal of the statement of the victim girl it reveals that the petitioner has committed penetrative sexual assault on the victim girl who is 10 years old.

6. Considering the facts of the case and the nature of offence committed by the petitioner and investigation in this case is not yet completed, this Court is not inclined to grant bail to the petitioner.
