and S.Sounthar,J This Habeas Corpus Petition has been filed by father/husband of the detenue, seeking to direct the respondent police 1 and 2 to produce the detenues (i) Saranya, aged 39 years, (ii) Minor girl Ms.Harshavardhini, aged about 9 years, (iii) Minor boy Mohith Saranath, aged about 7 years, (iv) Minor boy Mokshad, aged about 5 years from the custody of the 3rd and 4th respondents herein before this Court and set them at liberty.
2. Heard both sides.
3. The detenues are wife and children of the petitioner. Learned Additional Public Prosecutor would state that the detenues appeared before the respondent Police and stated that they are not in illegal custody. He would further state that the wife/1st detenue of the petitioner
had stated that due to some personal reason, she is not willing to go with the petitioner.
4. The above statement made by the learned Addtional Public Prosecutor is recorded. The 1st detenue is aged 39 years. She is the mother of the other detenues/children. She had stated before the Police that she and her children are not willing to go with the petitioner. The detenues are not in illegal custody. Thus, this Habeas Corpus Petition stands dismissed.
