ORDER

Mr.M.Bindran, learned Additional Government Pleader accepts notice on behalf of the Respondents. With consent of the learned counsel on either side, this writ petition is taken up for final disposal.

This Writ Petition has been filed seeking to direct the respondents herein to consider the petitioner's representation dated 21.07.2025 and grant the petitioner a revised pension as per G.O.Ms.No.236, Finance (Pay Cell) Department, dated 12.07.2018 with effect from 01.07.2018 and thereby pay the arrears accumulated so far.

3. The case of the petitioner is that the petitioner is a Senior Civil Surgeon and Specialist in Paediatrics, who retired from the Government Headquarters Hospital, Ooty on 09.03.1999. As per G.OMs.No.236, Finance (Pay Cell) Department, dated 12.07.2018 and the pensionary benefits of a medical officer of a particular category were revised with effect from 01.07.2018. Accordingly, she applied for revision of her pension on 2/5

24.05.2019. Due to the administrative delay, her claim was not processed. In the meantime, by letter dated 23.05.2020, the Government intimated a proposal to cancel the said G.O, with prospective effect. Subsequently, the third respondent, by letter dated 15.09.2020, rejected the petitioner's claim citing the proposed cancellation of the G.O. In response, the petitioner made a representation dated 21.07.2025 to the respondents. However, the same has not been considered till date. Hence, the present petition is filed for the aforesaid relief.

4. Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents.

Though many grounds have been raised by the petitioner, this Court finds it appropriate to issue a direction to the third respondent, without going into the merits of the case, to consider the representation of the petitioner dated 21.07.2025 and pass orders, on its own merits, in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. It is made clear that this Court has not made any observation with regard to the merits of the petitioner's claim. 3/5

6. With the above direction, this Writ Petition is disposed of. No costs.
