ORDER
This writ petition has been filed challenging the impugned letter of the 3rd respondent dated 06.10.2023 and for a consequential direction to the 3rd respondent to provide service connection to the
house belonging to the petitioner.

Heard Mr.M.D.Illayaraja,learned counsel for the petitioner and Mr.L.Jai Venkatesh, learned Standing counsel for respondents 1 to 3 and Mr.R.Sudhakar Raj, learned counsel for 4th respondent.

The 3rd respondent has refused to provide service connection to the petitioner on the ground that the 4th respondent has made an objection stating that there is a suit pending in OS No.144 of 2023 before the Additional Sub Court, Ponneri and that the 4th respondent has blocked the end of the pathway and thereafter, there is a patta land belonging to some third party. Under such circumstances, unless and otherwise a pathway is available for the 3rd respondent to effect the service connection, it is not possible for the 3rd respondent to give service connection from the existing electric pole since the wire has to necessarily cross the land of the 4th respondent.

In the considered view of this Court, there is a private dispute between the petitioner and the 4th respondent. As a
result, the 4th respondent has caused hindrance and thereby, the electricity department is not able to extend the wire from the main pole since it crosses the patta land of the 4th respondent. 5.
In view of the above, it is left open to the petitioner to make a fresh application / representation to the 3rd respondent seeking for shifting the service connection from some other pole and in which case, the learned counsel for the petitioner submitted that the petitioner is willing to bear the cost. On receipt of such representation, the 3rd respondent shall take a decision and do the needful within a period of six weeks from the date of receipt of the representation from the petitioner.

This writ petition is disposed of with the above directions. No costs. Consequently, the connected miscellaneous petition is closed.
