2. Heard the learned counsel on either side and perused the materials available on record.

3. On instructions, the learned Standing Counsel appearing for the

respondent submitted that there is a rival claimant for the death-cum-retirement benefits of late Rajagopal. The rival party claims that she is the first wife of late Rajagopal. Therefore, the respondent is unable to disburse the death-cumretirement benefits of late Rajagopal.

4. In view of the above, the representation submitted by the petitioner cannot be considered. However, the petitioner is at liberty to approach the Civil Court for declaration declaring that she is the legally wedded wife and can make claim before the respondent.

5. With the above directions, this writ petition stands disposed of. No costs.
