ORDER

The petitioner, who was arrested and remanded to judicial custody on 14.07.2025, for the offences punishable under Sections 191(2), 191(3), 103(1) of BNS Act in Crime No.369 of 2025, registered on the file of the respondent police, seeks bail.

The case of the prosecution is that due to previous enmity the petitioner joined hands with other accused and brutally attacked the son of the defacto complainant and caused his death. Hence, this case. 3.

The learned counsel appearing for the petitioner submitted that the petitioner is friend of the deceased and he was staying with him. At that time all the accused persons attacked the deceased and seeing the same he ran away from the place. As the deceased was not able to run away from the place, all the accused persons attacked the deceased and caused the death. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner. 2/4

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and states that the petitioner has no previous cases. He further submitted that the investigation is pending and this Court has dismissed the bail application for the co-accused in Crl.O.P.No.24922 of 2025 on 12.09.2025.

Considering the facts, gravity of offence and the fact that this Court had dismissed the bail application for the co-accused this Court is not inclined to grant bail to the petitioner. 6.
