ORDER

Today, this matter was listed under the caption, "for being mentioned" at the

instance of the learned counsel for the petitioner.

2. The main contention of the learned counsel for the petitioner is that instead of Spl.S.C.No.8 of 2023, originally, while filing the above Original Petition, Spl.C.C.No.8 of 2022 was mentioned. Hence, seeks for necessary correction.

3. The learned learned Government Advocate filed a status report indicating that originally the chargesheet was filed before the Special Court, District and Sessions Court of The Nilgiris at Ootacamud and the case was taken file as Spl.C.C.No.8 of 2022. Thereafter, during the pendency of the trial, the Special Court suo-motu converted the case from Spl.C.C to Spl.S.C and assigned a new Sessions Case Number namely Spl.S.C.No.8 of 2023 on 22.09.2023. From the said date, the case is pending trial under Spl.S.C.No.8 of 2023. Since, the petitioners have mentioned Spl.C.C.No.8 of 2022 while filing the above original petition, this Court quashed the Spl.C.C.No.8 of 2022 and allowed the original petition vide order dated 13.10.2025. The said status report is taken on record.

4. Heard both sides and perused the materials placed on record.

5. Considering the submissions of the learned counsel for either side and in view of the status report dated 06.12.2025 of the first respondent filed by the Government Advocate (Crl.Side), the Registry is directed to carry out the necessary corrections in the order dated 13.10.2025 passed in Crl.O.P.No.27806 of 2025 by modifying the Spl.C.C.No.8 of 2022 to Spl.S.C.No.8 of 2023 and issue order copies afresh. Except the above corrections, the order dated 13.10.2025 remains intact.
