Petition filed under Article 226 of the Constitution of India, praying to issue Writ of Habeas Corpus, to call for the entire records, leading to the detention of petitioner's husband, the detenu, Laddu @ Arumugam, aged 53, son of Raman, presently detained in Central Prison, salem, under Prevention of Black Marketing and Maintenance of Supplies of Essential Commodities Act, 1980 (Central Act 7/1980), branded as 'Black Marketer' vide the detention order dated 21.11.2023 in C.M.P. No.3/Black Marketer/Salem City/2023, on the file of the 2nd respondent herein, directing to produce the person or body of the detenu, before this Hon'ble Court and thereafter set him at liberty from the Central Prison, Salem, by set aside the above order. The petitioner, wife of the detenu, namely Laddu @ Arumugam, aged 53 years, S/o. Raman, has come forward with this petition challenging the detention order passed by the 2nd respondent dated 21.11.2023 slapped on her husband, branding him as "Black Marketer" as contemplated under the Prevention of Black Marketing and Maintenance of Supplies of Essential 2/5
Commodities Act, 1980 (Central Act 7 of 1980). 2.The learned Additional Public Prosecutor would submit that the order of detention passed by the second respondent as against the husband of the petitioner herein dated 21.11.2023 has been revoked by the Government in G.O. [Rt] No.09, Co-operation, Food and Consumer Protection (E1) Department, dated 08.01.2024 and he has also produced a copy of the said order.
