ORDER
The petitioners, who were arrested and remanded to judicial custody on 12.08.2025 & 14.08.2025 for the alleged offences punishable under Section 194 of BNS altered to 108 of BNS, in Crime No.481 of 2025 on the file of the respondent police, seek bail.
2. The case of the prosecution is that the petitioners are running gambling club. The deceased playing with card games by using huge money, thereby he lost money. Hence, the deceased committed suicide in railway track by having a suicide note in his hand implicating the petitioners name. Hence, the case.
3.The learned counsel for the petitioners submitted that the petitioners are running licensed club. Though it is alleged that the card games are illegal, but he has not spent huge money and a false allegation levelled against the petitioners. Hence, he prayed for grant of bail to the petitioners. 2/6
4.The learned Government Advocate (Criminal Side) appearing for the respondent police reported that FIR has been registered after the deceased committed suicide by falling in front of the train and the investigation is completed. Hence, he strongly opposed grant of bail to the petitioners.
5. Heard both sides and perused the materials available on record.
6. Considering the facts and circumstances of the case and the period of incarceration undergone by the petitioners and the investigation is also completed, this Court is inclined to grant bail to the petitioners with certain conditions;
7.Accordingly, the petitioners are ordered to be released on bail on their executing a bond for a sum of Rs.20,000/- (Rupees Twenty thousand only) each, with two sureties, for a like sum to the satisfaction of the learned Judicial Magistrate, Pallavaram and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety 3/6
ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;
[b] the petitioners shall report before the respondent police daily at 10.30 a.m., for a period of three weeks and thereafter as and when required for interrogation;
[c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];
[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 22.09.2025 dna 4/6
