ORDER
When the matter was taken up, both the counsels submitted that the dispute has been amicably settled between the parties and prayed to compound the offence. Both the parties have filed a petition for compounding the offence under Section 147 of the Negotiable Instrument act dated 31.10.2025 and the same is brought on record.
"1.The petitioner submits that the petitioner / appellant has preferred this revision against the respondent for the offence punishable under section 138 of Negotiable Instruments Act 1881.
2.The petitioner submits that the above revision came up for hearing before the Hon'ble High Court of Madras on 31.10.2025 and the Hon'ble High Court of Madras after hearing both parties directed the parties to settle the dispute between them amicably.
3. The petitioner submits that the respondent and the petitioner / appellant have mutually arrived on a terms and conditions to the effect that to settle the disputes amicably out
of the Court.
4.The petitioner submits that the petitioner / appellant and the respondent mutually agreed that the petitioner will pay an amount of Rs.1,00,000/- (Rupees one Lakh only) to the respondent as full and final settlement towards the dishonored cheque on the file of XXV Metropolitan Magistrate - Egmore, Chennai-600 008 in STC.No.356 of 2023 in the following manner:
(i) The petitioner paid today sum of Rs.64,000/- (Rupees sixty thousand only by way of demand draft bearing DD.No.050302 dated 31.10.2025 drawn in State Bank of India. (ii) Remaining balance amount Rs.36,000/- (Rupees Thirty Six Thousands only) amount shall be directly withdrawn by the respondent from the lower court which was already deposited by the petitioner before the XXV Metropolitan Magistrate -Egmore, Chennai-600 008, in STC No.356 of 2023 as compensation for which the petitioner has no objection. 5.The petitioner / appellant agreed and accepted the same to withdraw the Criminal Revision No.2209 of 2025 by filing a petition under Section 147 of Negotiable Instruments Act 1881 and under Section 359(5) of BNSS 2023 on completion of full and final payment of the said amount.
IN view of the full and final settlement, the petitioner / appellant is willing to compound the offence involved in this case with the respondent."
2. Since, the matter has been settled, the complaint given by the defacto complainant is dismissed as settled and the accused is acquitted of all the charges.
3. The balance amount, by way of Demand Draft, has been paid today to the respondent. The respondent is permitted to withdraw the amount deposited before the trial Court.
4. The compromise memo shall form part of this order. Accordingly, this Criminal Revision Case is disposed of. Consequently, the connected miscellaneous petition is closed.
