Respondents PRAYER : Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing respondents 1 to 4 herein to consider and act upon the petitioners' representations dated 09.06.2025, 11.06.2025 and 14.07.2025 and forthwith for removal of illegal encroachment made by respondents 5 to 7 herein in the Government Poromboke land comprised in Survey Nos.526/2, 527/2, 528/2 and 529/1 situated in Sundekuppam-II Village, Periyamuthoor Firka, Krishnagiri Taluk and District and thereby ensuring that the village community have pathway to access their agricultural fields and
their houses and to access the village community spaces like playground, school and marriage hall without any disruption, within a stipulated time frame.

ORDER
(Order of the Court was made by the Hon'ble Chief Justice) Alleging encroachment on a pathway (government land), petitioners made a complaint. Taking cognizance of the said complaint, the Block Development Officer, vide his communication dated 25.6.2025, directed the Tahsildar to conduct survey.
2. The petitioners have filed this petition as, according to them, the Tahsildar, till date, has not conducted any survey, despite repeated representations made by the petitioners.
3. Taking into consideration that the letter was sent by the Block Development Officer to the Tahsildar on 25.6.2025, we are not inclined to keep this petition pending. The Tahsildar, if he has not conducted survey so far, should expeditiously conduct survey
and based upon the report of survey, appropriate action is required to be taken.
Writ petition is disposed of accordingly. There shall be no order as to costs. WMP No No.40507 of 2025 filed by the petitioners to join together and file a single writ petition is allowed, subject to payment of separate court-fee within two weeks.
