..Respondent PRAYER: Civil Miscellaneous Petition is filed under Section 151 of C.P.C, seeking to permit the petitioner to withdraw the amount of Rs.5,00,000/- (Rupees Five Lakhs Only) deposited by the petitioner in O.S.No.378 of 2013 on the file of learned I Additional District Judge, Coimbatore as per the order passed in C.M.P.No.22928 of 2018 in A.S.No.865 of 2018 dated 07.01.2019 by this Court along with accumulated interest. Heard the learned counsel for the petitioners.
2. Mr.R.Narayanan, learned counsel for the respondent does not have any serious objections in allowing the application.
3. In C.M.P.No.22928 of 2018, while granting an order of interim stay, this Court directed the petitioner/defendant to deposit a sum of Rs.5,00,000/- to the credit of O.S.No.378 of 2013 on the file of the I Additional District Court, Coimbatore.
4. The learned counsel for the petitioner submitted that in compliance with the said direction, the petitioner/defendant depostied the aforesaid sum before the trial Court on 15.02.2019. A copy of the challan evidencing such deposit has been produced.
5. The learned counsel for the petitioner further submitted that, during the execution proceedings, the petitioner/defendant settled the entire decretal amount. Therefore, he seeks permission of this Court to withdraw the sum of Rs.5,00,000/- deposited before the trial Court.
6. In view of the above submissions and as the entire decretal amount has been satisfied, the petitioner is permitted to withdraw the sum of Rs.5,00,000/- deposited to the credit of O.S.No.378 of 2013, along with accrued interest, if any, by filing an appropriate application before the trial Court.
