ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.This case in Cr.No.52 of 2018 dated 14.03.2018. After completion of investigation, it was charge-sheeted for the offence Section 143, 144 r/w.149 of IPC and 25(1)(a) of Arms Act, 1959. The allegation is that the Accused joint together as unlawful assembly and armed with deadly weapons for the purpose of retaliating the murder of a person. For the said allegation, the case is pending from 2018. Some of the Accused have been facing the case and for some accused, summons had not been served.

3.Considering the nature of allegation, the antecedents of the accused, it is evident that even if the accused is continuing to face trial, it would impinge upon his right to a speedy trial. 4. Accordingly, the case in CC.1500215/2018 on the file of the Judicial Magistrate VII , Puducherry Taluk, Puducherry stand quashed. This Suo Motu Transfer Case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
