C.M.P.No.7117 of 2024 in C.M.A.SR.No.48373 of 2022 N.ANAND VENKATESH , J This Civil Miscellaneous Petition has been filed seeking to condone the delay of 388 days in paying the deficit Court fee.
2. Heard the learned counsel for the appellant and perused the records.
3. Ms.R.Rathna Thara, learned counsel, takes notice on behalf of second respondent and undertakes to file vakalath on behalf of second respondent.
4. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, this miscellaneous petition is allowed and the delay of 388 days in paying the deficit court fee is condoned.
5. Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order and list the same for admission in due course. Registry is directed to print the name of Ms.R.Rathna Thara, learned counsel, at the time of admission.
It is made clear that for the period of delay of 388 days, the appellant will not be entitled for any interest if in the event of this Court enhancing the amount of compensation fixed by the Tribunal.
