..Respondent Prayer: Contempt Petition filed under Sec.11 of the Contempt of Courts Act, 1972 to punish the respondent for disobeying the order of this Court dated 11.08.2023 in CMA.No.1038 of 2023.

ORDER

This Contempt Petition is filed by the petitioner seeking to punish the respondent for wilfully disobeying the order of this Court dated 11.08.2023 in CMA.No.1038 of 2023.

2. Learned counsel for the petitioner would contend that it has been stated in the communication of the respondent issued to Salem Government, Mohan Kumaramangalam Medical College Hospital, Salem to issue disability certificate to the employees of the petitioner/Management in order to determine the compensation in line with the directions issued by this Court in paragraph Nos.6 and 7 in CMA.No.1038 of 2023, dated 11.08.2023. However, the above said hospital has not issued disability certificate to the employees of the petitioner/Management so far.

3. Learned Addl. Govt. Pleader appearing for the respondent would submit that in due compliance of the Order made by this Court in CMA.No.1038 of 2023, the respondent has sent a communication to the Authority concerned, Salem Government, Mohan Kumaramangalam Medical College Hospital, Salem on 19.08.2024 followed by reminders on 25.02.2025, 26.03.2025 and also summons on 26.09.2025 enclosing the order of the court dated 11.08.2023 and also a copy of this contempt petition requesting to issue disability certificate . But sofar, the abovesaid hospital has not intended to take steps to issue disability certificate in compliance of the order of this court dated 11.08.2023.. Thus, he would submit that the order of this Court made in CMA.No.1038 of 2023, dated 11.08.2023 has been duly complied with by the respondent herein.

4. Heard both sides and perused the communications sent by the respondent to Salem Government, Mohan Kumaramangalam Medical College Hospital, Salem. It is seen that the respondent has duly complied with the directions made by this court in CMA.No.1038 of 2023, dated 11.08.2023 by issuing communication dated 26.09.2025 enclosing copy of the court order and contempt petition to the abovesaid Hospital.
