PRAYER: Original Petition filed under Section 372 of Indian Succession Act, 1925 read with Order 25 Rule 6 of O.S.Rules, prays that a succession certificate may be granted to the petitioner with the debts power to collect and to receive the interest and dividends on and negotiate and transfer the securities specified in the schedule hereto.

ORDER
The petitioners seek Succession Certificate in respect of the securities held by Late V.V.Muthukumarasamy and V.M.Rani, who died intestate on 20.04.2021 and 17.06.2021. The petitioners are the brothers of the deceased V.V.Muthukumarasamy. The petitioners are declared as legal heirs of the deceased persons in O.S.No.6599 of 2022.

2. The first petitioner has been examined as PW1. He has produced the computer generated death certificates of the deceased persons as Ex.P1 and Ex.P2. The photocopy of the Aadhar card of the petitioners as Ex.P7 and Ex.P9. The decree and judgment copy in O.S.No.6599 of 2021 as Ex.P11 and Ex.P12. On perusal of Ex.P1, Ex.P7 and Ex.P9, shows that the father of the male deceased and the petitioner are one and the same. On perusal of Ex.P11 and Ex.P12, it shows that the City Civil Court declared the petitioners are the legal heirs of the deceased person V.V.Muthukumarasamy. A paper publication has been made and no objections have been received.
3. The assertions in the petition have been duly proved by adducing oral evidence supported by documents. In these circumstances, the petitioners are entitled to the relief.
4. In view of the above evidence, the Original Petition is allowed granting Succession Certificate in favour of the petitioners, with the power to collect the securities and receive the interest and dividends mentioned in the schedule to the petition.
