O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 3(2)(b), 4(1), 4(2)(c) of Immoral Traffic (Prevention) Act, in Crime No. 367 of 2025, on the file of the respondent Police, seeks anticipatory bail. 2.The case of the prosecution is that based on a complaint given by 1/6

one Madhan Kumar, the premises of the petitioner were searched and the petitioner was arrested for running a prostitution under the guise of SPA. During the raid, the respondent police found three victim girls and a customer inside the SPA premises. Hence the case.

3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he has been falsely implicated in this case. He further submits that he has not committed any offence as alleged by the prosecution. He further submits that the co-accused/A1 & A3 were granted anticipatory bail in Crl.O.P.No.21673 of 2025, dated 09.09.2025 and Crl.O.P.No. 23924 of 2025, dated 01.09.2025. He also submits that the petitioner is ready to abide by any conditions that may be imposed by this Court and ready to furnish sufficient solvent sureties for his release. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal side) appearing for the respondent police, reiterated the prosecution case and submits that one previous case is pending against the petitioner herein similar in nature. He further submits that based on the statement of three victims girls, the 2/6

petitioner herein implicated in this case. However, he opposed for grant of anticipatory bail to the petitioner.

Taking into the fact that one previous case is pending against the petitioner similar in nature; that the statement of three victim girls who have also been recorded, implicated the petitioner herein and his overt-act in the crime and hence, this Court is not inclined to allow this Criminal Original Petition.

6. Accordingly, this Criminal Original Petition is dismissed. 17.09.2025 MSM To 1.The JM No.II, Tiruppur.
