O R D E R

This writ petition has been filed in the nature of a mandamus seeking a direction to the 3rd respondent viz., The District Manager, Tamil Nadu State Marketing Corporation Limited (TASMAC), Villupuram District to permit the petitioner to continue as supervisor in TASMAC shop No.11412 at Tindivanam Town.

2. The petitioner was working as Supervisor in TASMAC shop No.11412 at Tindivanam Town. The 4th respondent, who was earlier working in TASMAC shop No.11552, was transferred to TASMAC shop No.11412 and the petitioner was transferred to TASMAC shop No.11444.

In the writ petition earlier filed by the 4th respondent in W.P.No.31124 of 2024, a learned Single Judge of this Court, by order dated 28.10.2024, observed that the sales in TASMAC shop No.11412 is more than Rs.2 Lakhs and had directed that the 4th respondent must also be appointed as Supervisor in TASMAC shop No.11412, wherein, the petitioner herein was already working as Supervisor.

4. It is stated that since the sales was more than Rs.2 Lakhs, there can be two Supervisors. But, unfortunately, the two supervisors started fighting between themselves leading to further issues. There was already an order transferring the petitioner from TASMAC shop No.11412 to 11444. Both the shops are in Tindivanam Town, within a range of one kilometer. There cannot be any vested right in any individual to claim a right to work in one particular shop. Following directions are therefore issued :

i. The petitioner viz., P.Saravanan, may work as Supervisor in TASMAC shop No.11444 at Tindivanam Town. If there are no further allegations, let him not be disturbed for at least two years. 3/6

ii. S.Anandhan/4th respondent may work as Supervisor in TASMAC shop No.11412, Tindivanam Town. Let him continue to work there, if there are no allegations for at least two years. iii. Thereafter, the 3rd respondent may take a decision to transfer either of them or to retain them in the same shop.

With the above direction, this writ petition is disposed of. No costs. 16.04.2025 gya Index : Yes/No 4/6
