ORDER

The petitioner, who apprehends arrest for the alleged offence under Sections 8(c), 20(b)(ii)(A), 25, 29(1) of NDPS Act and Section 132 of BNS, in Cr.No.133 of 2025, seeks anticipatory bail.

2. The case of the prosecution is that on 28.06.2025, at about 5.00 hours, the Sub-Inspector of Police on duty received secret information from his informer. After obtaining permission from the Inspector of Police, the police team proceeded to the spot, whereupon some accused persons, including the petitioner, were found in possession of 452 grams of ganja without any valid licence, purportedly for the purpose of sale at high prices.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner is implicated in this case based on the confession of other accused and that the petitioner did not present in the scene of occurrence, hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (crl.side) would submit that totally there are four accused and the petitioner is arrayed as A4. He further submitted

that A1 to A3 have already been released on bail. He also submitted that investigation is at crucial stage. If the accused is released on anticipatory bail, he will either abscond or commit similar offence and that there is every possibility of him interfering with further investigation in the case. Hence, he vehemently opposed to grant bail to the petitioner.

Considering the facts and circumstances of the case and considering the gravity of offence committed by the petitioner and there is possibility of petitioner involves in similar offences, hence, this Court is not inclined to grant extra-ordinary relief of anticipatory bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. 19-09-2025 gbi Index:Yes/No Speaking/Non-speaking order Internet:Yes
