This writ petition has been filed for issue of writ of mandamus directing the 2nd respondent to issue patta in the name of the petitioner with respect to the subject property based on the on-line application submitted by the petitioner on 08.10.2024. 2.Heard Mr.M.Saravana Kumar, learned counsel appearing on behalf of the petitioner and Mr.A.Selvendaran, learned Special Government Pleader appearing on behalf of the respondents.
3.The petitioner is claiming title over the subject property through Sale Deed dated 26.03.2007 which was executed in favour of the husband of the petitioner. A patta was also issued in the name of the husband of the petitioner in Patta No.864. After his demise, the petitioner is seeking for transfer of patta in her name. During the life time of the petitioner's husband, a portion of the property was sold in favour of one Chinnathambi and hence, the patta also stands in the name of Chinnathambi. The online application was made by the petitioner seeking for patta in her name for the portion of the property which was not sold and which continues to be owned and possessed by the 2/4
petitioner. Since the same was not considered, the present writ petition has been filed before this Court.
3.Taking into consideration the facts and circumstances of the case and also the limited relief that has been sought for in this writ petition, there shall be a direction to the 2nd respondent to deal with the on-line application submitted by the petitioner on 08.10.2024 and transfer the patta in the name of the petitioner with respect to the portion of the property that continues to be owned and possessed by the petitioner. This process shall be completed by the 2nd respondent, within a period of four weeks from the date of receipt of copy of this order.
