This petition has been filed to condone the delay of 109 days in filing the appeal against the judgment and decree dated 27.03.2024 made in MACTOP No.837 of 2022 on the file of the Motor Accident Claims Tribunal Judge /Principal District Judge, Tiruvannamalai District.

2. Mr.S.Senthil Kumar takes notice for the second respondent. Though the name of the first respondent is printed in the cause list, no one appeared on his behalf. Heard the learned counsel for the appellant and the learned counsel for the second respondent.

3. Being satisfied with the reasons stated in the affidavit filed in support of this petition, this Court is inclined to order this petition.

4. Accordingly this Petition is ordered. Registry is directed to number the appeal, if it is otherwise in order and post the main appeal for admission. It is underscored that in the eventuality of the appellant succeeding in the appeal to be taken on record, she would not be entitled to any interest for the above 109 days.
