Respondent(s) PRAYER:-Writ petition filed under article 226 of the Constitution of India, praying for an issuance of Writ of Mandamus, directing the respondents 2 and 3 herein to survey the lands of the petitioner herein in Re-Survey Nos.381/3, 381/4 (part) to an extent of 4,366-3/4 sq.ft and Re-Survey No. 381/4 (part) to an extent of 815 sq.ft totalling to an extent of 5,181- 3/4 sq.ft of Erode A village and to fix the F Line and boundary stones for the said property based on the representation of the petitioner dated 28.08.2024 and payment of the survey charges paid on 27.08.2024 within time frame fixed by this Court. ORDER
This writ petition has been filed by the petitioner seeking to direct the respondents 2 and 3 herein to survey the lands of the petitioner herein in ReSurvey Nos.381/3, 381/4 (part) to an extent of 4,366-3/4 sq.ft and Re-Survey No. 381/4 (part) to an extent of 815 sq.ft totalling to an extent of 5,181- 3/4 sq.ft of Erode A village and to fix the F Line and boundary stones for the said property based on the representation of the petitioner dated 28.08.2024 and payment of the survey charges paid on 27.08.2024. 2.Mr.C.Jayaprakash, learned Government Advocate, takes notice on behalf of the respondents 1 to 4. By consent of the parties, the main writ petition is taken up for disposal at the admission stage itself. 3.Learned counsel for the petitioner would submit that based on the nd respondent measured the petitioner's representation dated 03.06.2024, the 2
property purchased by the petitioner's Trust under Doc.No.3784. In the said measurement and the sketch, the boundaries of the property were wrongly shown. Therefore, to rectify the said anomaly, the petitioner made a nd respondent to once again measure the representation on 28.08.2024 to the 2 property purchased by the Trust and fix the boundary stones and the necessary nd respondent did not take any fees also been paid by the petitioner. Since the 2 action, the petitioner sent the reminders dated 10.09.2024 & 03.12.2024. nd respondent. Hence, the However, so far no action had been initiated by the 2 present writ petition.
4.Learned Government Advocate appearing for the respondents 1 to 4 would submit that the representation of the petitioner dated 28.08.2024 will be considered within a period of four weeks.
5.Heard the learned counsel for the petitioner as well as the learned Government Advocate appearing for the respondents 1 to 4 and perused the materials available on record.
6.Considering the submission made by both the parties and in view of the limited prayer sought for in this Writ Petition, without going into the merits of the case, this Court directs the respondents 2 and 3 to consider the representation of the petitioner dated 28.08.2024 and complete the survey and fix the boundaries after issuing due notice to the concerned parties, if any. It is needless to state that, if there is any obstruction, the respondents 2 and 3 shall complete the process with the aid of the Police. Such exercise shall be done by the respondents within a period of four weeks from today. 7.With the above said direction, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
