The petitioner/accused in Crime No.2 of 2023 registered under Sections 376 (2) (n), 506 (2), 363, 366 & 376 (3) IPC and Section 5(l) & 6(1) of POCSO Act and 67 B of Information Technology Act and remanded to judicial custody on 26.03.2023 seeks bail. 2.It is the case of the prosecution that the victim child informed that the petitioner had told her that he wanted to be in relationship with her and that he had taken selfies with her and shared those photographs in whatsapp and shared obscene videos.

3.The statement of the victim child recorded under Section 164 (5) Cr.P.C., had been forwarded to this Court and a perusal of the same shows that she had reiterated the allegations as stated in the complaint. One further fact is that the petitioner herein had been earlier taken into custody in Crime No.201 of 2022, registered by the Thanipadi Police Station at Tiruvannamalai, under Sections 254 C, 376(2)(n), 506 (ii) IPC.

He had been taken into custody on 30.08.2022 in that particular case. The victim child was a young girl of 19 years studying in a college. There the accused had approached the victim child as a Karate Teacher and developed friendship with her. In that particular case, a learned Single Judge had granted bail on 11.10.2022. While on bail, the present offence had been committed. It is thus seen that the petitioner is a repeat offender. Therefore, I am not inclined to grant bail to the petitioner. 4.Accordingly, this Criminal Original Petition stands dismissed. 19.12.2023 sli
